Welcome to KMS Business Solutions Ltd trading as Employee Health 360 ("we", "us" "our"). By purchasing service or products from us, whether via email, electronic message or by phone, you agree to the following terms and conditions:
 

1. Services and Products

We offer proactive health services, including functional health assessments, screening tools, and at-home test kits. Our services are not a substitute for medical advice, diagnosis, or treatment by a licensed medical practitioner.

2. Ordering and Payment

Orders may be placed via email, electronic messaging or by phone. Full payment is required before test kits or services are dispatched.

3. Delivery of Test Kits

Test kits are typically dispatched within 2–3 working days of payment. You are responsible for providing accurate shipping information. We are not liable for delays caused by postal services or third-party couriers.

4. Returns and Refunds

4.1 Right to Cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, customers purchasing at a distance (e.g., by phone or online) have the right to cancel their order within 14 days of receiving their goods — unless exemptions apply.

4.2 Exemptions

Health test kits are sealed for hygiene and health protection purposes and are non-refundable once dispatched, in accordance with Schedule 3, Section 28(b) of the Consumer Contracts Regulations.

4.3 Discretionary Partial Refunds

If a client chooses not to proceed before the sample is returned to the lab, we may offer a partial refund, at our discretion. 

A minimum of £25 will be deducted to cover:

• Shipping and packaging
• Administrative processing
• Any applicable lab handling costs

No refunds will be issued once a sample is in transit to or received by the lab.

4.4 Faulty or Damaged Goods

If you receive a damaged or incomplete test kit, please notify us within 48 hours of receipt. We will offer a replacement where appropriate.

5. Use of Tests and Interpretation

By purchasing a test kit, you agree to use it responsibly and follow the instructions provided. We are not liable for misuse, misinterpretation, or failure to follow up with appropriate care.

6. Health Disclaimer

All content and services provided by us are for informational and educational purposes only. They are not intended to replace medical care. Always seek advice from your GP or a qualified health provider regarding any medical condition.

7. Limitation of Liability

We do not accept liability for any loss or damage (direct or indirect) resulting from the use of our tests or services, except where caused by our proven negligence.
